Special Laws and Regulations for Nevada First Responders

Nevada law recognizes the unique risks faced by first responders, carving out important exceptions to the general workers’ compensation rules to make it easier to establish compensability.

The Heart and Lung Bill (found primarily in NRS 617.455 and NRS 617.457) is critical legislation governing occupational disease claims for first responders. This bill is designed to assist first responders in establishing compensability for claims involving:

  • Diseases of the Heart and Lungs: The law makes it easier to establish that these conditions are work-related.
  • Cancer: Exposure to known carcinogens results in a rebuttable presumption that the cancer is work-related. This special rule applies to a range of occupational cancers. Nationally, there is strong medical evidence, for example, that prostate cancer should be considered an occupational cancer for firefighters. Firefighters are also increasingly exposed to dangerous chemicals, such as PFAS, which are linked to negative health impacts, including certain cancers.

Mental Health and PTSD Claims

First responders often face duty-related Post-Traumatic Stress Disorder (PTSD) and cumulative trauma exposure. For these complex claims, strong clinical documentation is key to clarifying the legitimacy and severity of the injury. Structured trauma treatment, such as residential programs, can generate the necessary comprehensive documentation, including:

  • Comprehensive diagnostic evaluations
  • Daily clinical documentation and progress notes
  • Clear documentation of functional impairment
  • Independent clinical perspectives from licensed trauma clinicians
